Acceptable Use & Anti-Spam Policy

Last modified: October 17, 2026. This policy outlines prohibited behaviors and mandatory compliance rules for sending automated messages via whatiha.

01. Core Principle: 100% Opt-In Required

whatiha is built for legitimate businesses providing responsive, high-touch conversational assistance to prospective and existing clients. We enforce a zero-tolerance policy against unsolicited commercial messaging (SPAM).

Before sending automated messages or voice memos to any WhatsApp contact, you must verify that the recipient:

  • Initiated communication with your business directly (e.g., sent an inbound message, clicked a WhatsApp ad, or requested support); OR
  • Provided explicit, verifiable prior opt-in consent through your website, intake form, or point-of-sale system authorizing WhatsApp contact.

02. Immediate Opt-Out & Honoring STOP Requests

Recipients must be provided with an immediate, frictionless method to revoke consent. whatiha automatically detects negative consent triggers including:

STOPARRETUNSUBSCRIBEDESACTIVARتوقفCANCEL

Upon receiving an opt-out intent, your system must immediately cease all automated outreach and ghosted follow-up drip loops. Overriding an opt-out flag to continue messaging is a material breach of this policy and grounds for immediate termination.

03. Strictly Prohibited Content & Use Cases

You may not use whatiha to transmit, promote, or orchestrate:

Deceptive & Illegal Activities
  • Phishing, credential harvesting, or deceptive impersonation
  • Pyramid schemes, multi-level marketing (MLM), or unregistered crypto get-rich offers
  • Selling scraped contact lists or unverified phone databases
Restricted Goods & Harassment
  • Prescription drugs, unlicensed medical dispensaries, or narcotics
  • Weapons, explosives, ammunition, or fireworks
  • Adult content, escort services, or explicit material
  • Harassment, threats, hate speech, or defamatory messaging

04. Rate Limiting & Sending Window Compliance

To maintain tier health and prevent carrier spam classification:

  • Respect Local Calling/Texting Windows: Automated outbound notifications and phone calls must observe local business hours (typically 08:00 to 20:00 local recipient time), unless responding directly to an immediate inbound prompt.
  • Cadence & Pacing: Outbound campaigns must utilize whatiha’s automated warmup and jitter pacer algorithms. Bypassing rate limits with high-frequency blasts will trigger automated safety circuit breakers.

05. Enforcement, Suspension & Termination

whatiha continuously audits delivery metrics, block rates, and user complaint signals. If your account incurs an abnormally high block or report rate (> 2%):

  1. Your outbound sending queues will be temporarily paused for manual inspection.
  2. You will be requested to provide proof of opt-in consent for the targeted recipients.
  3. Failure to furnish verifiable consent will result in immediate account termination without refund.

06. Reporting Violations

If you have received an unauthorized or abusive message originating from a phone number powered by whatiha, please forward the details to abuse@whatiha.ai. We investigate all complaints within 24 business hours.
